YOUTH INFORMATION

PARTICIPANT RELEASE AND INDEMNITY *

Participant Release and Indemnity

  1. Assumption of Risk: The Participant understands, acknowledges and is aware of all inherent risks and dangers in the Program and freely and voluntarily assumes any and all risks and hazards that may arise from or during the Program, including without limitation, risks association with any temporary overnight accommodation related to the Program. The Participate acknowledges and agrees that participation in the program shall be entirely at the Participant’s own risk.
  2. Medical Care: The Participant acknowledges that the Program leadership may from time to time, secure or arrange such medical advice and services as it, in its sole discretion, may deem necessary for the health, safety and wellbeing of the Participant. The Participant hereby consents to any and all medical services and all associated expenses relating thereto.
  3. Indemnity and Release: The Participant hereby irrevocably indemnifies and saves harmless and releases the Organization, its successors and assigns, from and against any and all liabilities, actions, damages, claims, losses, costs, orders, fines, penalties, and expenses whatsoever which may be sustained, suffered or incurred by the Organization, its successors and assigns, in connection with or arising out of, directly or indirectly, the Participant’s participation in the Program. The Participant covenants and agrees not to assert any action or claim against the Organization, its successors and assigns, in connection with or arising out of, directly or indirectly, the Participant’s participation in the Program. This section 4 shall survive the Participant’s participation in the Program.
  4. Severability: If any part or parts of this Agreement shall be held unenforceable or invalid for any reason, the remainder of this Agreement shall continue in full force and effect, and if limiting such provision would make the provision valid, then such provision shall be deemed to be construed as so limited.
  5. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the Province of Alberta, and where applicable, the laws of Canada.
  6. Acknowledgement: The Participant has read and understood this Agreement, and has had the opportunity to ask questions about same. The Participant fully understands this Agreement, that the Participant is giving up substantial rights in connection therewith, and that the terms herein are contractual, not merely recital. The Participant further acknowledges that they are signing this Agreement freely and voluntarily and without undue pressure, inducement, coercion or duress of any kind.
  7. Parent/Legal Guardian: For participants of minority age, I hereby certify that I, as parent/legal guardian with legal responsibility for the Participant of minority age, do consent and agree to the Participants participation in the Program and to all of the terms herein for and on behalf of the Participant. I fully understand the inherent risks in the Program and agree to indemnify, save harmless and release the Organization, its successors and assigns, for myself, my successors, heirs and assigns, in accordance with section 4 herein, for the Participant of minority age participation in the Program.

PARTICIPANT RELEASE OF MULTI-MEDIA *

Participant Release of Multi-Media

Your approval is required so that we may take writing samples, drawings, photographs, sound recordings and/or videos of participants, and other related materials produced by or representing the likeness of participants who take part in the Program. These activities assist us in evaluating and promoting the Program and help educators and other interested groups learn more about McMurray Gospel Assembly and the youth cabin trip.

1. All or portions of the work referred to above will become part of the databases of McMurray Gospel Assembly and will be used solely for the purposes of education and public information. They may be published, exhibited, reproduced, and/or distributed in various media formats to a number of markets. They may also appear on the internet, including but not limited to, use on the websites of MGA, and social media such as to Facebook, Instagram, and Twitter.
2. The Participant, or parent/legal guardian of the Participant, hereby agrees to allow, without compensation, the following to be exclusively used, reused and published by the Organization for any educational, marketing, promotional materials, advertisement, and media-related purposes (electronic or print) of the Organization:

At any time, the Participant, or parent/legal guardian of the Participant, have the right to withdraw the approval of the above approved materials being used which have not been publicized or are not yet in the process of publication, by written notice to the program coordinator. The Participant and parent/legal guardian of the Participant hereby acknowledge that the Organization shall not be responsible for any third party unauthorized use or distribution likeness of the Participant, nor the above materials checked “yes” (if any), nor the use of the Participant’s legal name or nickname/alias (if checked). The Participant and parent/legal guardian of the Participant further acknowledges and accepts that risk herein that while the Organization uses reasonable efforts to minimize unauthorized use or distribution, it cannot control anything within the public domain.

4. The Participant and parent/legal guardian of the Participant hereby waive any right to inspect the product and henceforth and forever indemnify and release the Organization from any liabilities, claims or obligations arising from their use and from any financial compensation or recognition in connection therewith.

5. If any part or parts of this Agreement shall be held unenforceable or invalid for any reason, the remainder of this Agreement shall continue in full force and effect, and if limiting such provision would make the provision valid, then such provision shall be deemed to be construed as so limited.

6. This Agreement shall be governed by and construed in accordance with the laws of the Province of Alberta, and where applicable, the laws of Canada.
